All of these services are referred to as <b>NG Remote Trust Services<\/b> or <b>NGRTS<\/b>. NGRTS services can be used through a web portal or via API (web service calls).  <\/div>\n<p><\/p>\n<h2>CONTRACTUAL DOCUMENTS<\/h2>\n<div>\n<p>The contractual documents binding Users in the context of using the Services are, in order of priority (hereinafter &#8220;Contractual Set&#8221;):<\/p>\n<ul>\n<li>These Terms of Use;<\/li>\n<li><u><a href=\"https:\/\/www.ng-sign.com\/wp-content\/uploads\/2024\/05\/NG-DPP-WEB_1.0.pdf\">The privacy policy for website users<\/a><\/u><\/li>\n<li><u><a href=\"https:\/\/www.ng-sign.com\/wp-content\/uploads\/2024\/05\/PKI-DPP-RTS_1.0.pdf\">The privacy policy for online service users<\/a><\/u><\/li>\n<li>Where applicable, the certification policies and certification practice statements, in the case of using ngcert certification services.<\/li>\n<\/ul>\n<p>These documents are listed in this order and explicitly referenced during the registration step or first-time use of any NGRTS service. Acceptance of these documents is always displayed in the form of links that allow the documents to be downloaded. <\/p>\n<p>The documents are freely downloadable from the website homepage.<\/p>\n<\/div>\n<h2>ACCEPTANCE<\/h2>\n<p>To access the service, the customer must accept the contractual set defined above and acknowledges that by using any NGRTS service under the conditions defined herein, they declare having read and accepted them without reservation.<br><\/p>\n<p>User acceptance is confirmed by clicking the checkbox on the Website when creating a User Account or prior to the Electronic Signature of a Document using the Service.<\/p>\n<p>The customer implicitly acknowledges that acceptance of the contractual set does not require a handwritten or electronic signature.<br><\/p>\n<h2>SERVICE FOR ESTABLISHING AND PRESERVING ELECTRONIC EVIDENCE<\/h2>\n<p>Electronic signature is a technical process that gives electronic documents the same value as paper documents. This process ensures the identification of the signatory, the integrity of the document, and demonstrates the signatory&#8217;s consent to the signed document. <br>The implemented process enables:<\/p>\n<ul>\n<li>The creation of an original electronically signed document<\/li>\n<li>Timestamping of the original document<\/li>\n<li>The creation, transmission, and potentially archiving of the document<\/li>\n<\/ul>\n<h2>ACCESS AND USE OF THE SERVICE<\/h2>\n<p>Access to and use of the NGRTS service requires that the customer has the legal capacity and authorizations to commit under these terms; that they have a valid email address, an active personal phone number, and all hardware and software necessary for web browsing and opening and saving pre-contractual or contractual documents to be signed.<\/p>\n<p>Access to and use of the service requires the creation of a user account; the customer must first register on the NG-SIGN website (https:\/\/app.ng-sign.com.tn or https:\/\/app.ng-sign.com).<\/p>\n<p>For any transaction, your signature will be triggered and affixed when you click the &#8220;sign&#8221; button, thereby expressing your consent to the obligations of the signed document. A copy of your electronically signed document will be sent to you by email. <\/p>\n<p>The NGSign and QRSecure services operate 24\/7; except in cases of force majeure or difficulties related to the structure of communication networks.<\/p>\n<p>In accordance with the law, NG TECHNOLOGIES cannot be held liable for any damage resulting from customer fault or an unforeseeable and insurmountable event by a third party external to the provision of the service or a case of force majeure.<\/p>\n<p>The user is prohibited from any fraudulent use of the service and, in general, any activity through the service that would violate applicable laws and regulations.<\/p>\n<p>In any event, NG TECHNOLOGIES cannot be held liable for indirect damages that may result from the use of the website and\/or service. Indirect damages are those that do not result exclusively and directly from a failure of the website or service attributable to NG TECHNOLOGIES, namely losses of operation and commercial damages. <\/p>\n<h2>SERVICE EVOLUTION<\/h2>\n<p>NGRTS services are delivered in SaaS (Software as a Service) mode. They may be supplemented, modified, or replaced at any time based on technological innovations, legislative advances, or updates to improve service performance and functionality.<br>Consequently, in the event of modifications to the Terms of Use, NG TECHNOLOGIES undertakes to inform users of any new version of the Terms of Use by all available means. <br><\/p>\n<h1>SERVICE QUALITY<\/h1>\n<p>NG Technologies strives to provide a quality Service with 24\/7 availability.<br>NG Technologies cannot be held responsible for the proper functioning of the User&#8217;s computer or telephone equipment or their access to the Internet or a mobile telephone network.&nbsp;<\/p>\n<h1>SECURITY<\/h1>\n<p>NG Technologies undertakes to deploy its best efforts, in accordance with industry standards, to secure the Service.<br>In the context of accessing the Service, the User is expressly reminded that the Internet is not a secure network. Under these conditions, it is the User&#8217;s responsibility to take all appropriate measures to protect their own Data and\/or software, particularly from potential misappropriation and contamination by viruses circulating on the Internet or intrusion by third parties into their information system for any purpose, and to verify that transmitted files do not contain any computer viruses.<br>NG Technologies disclaims all liability regarding the spread of computer viruses and all consequences that may result from such viruses. &nbsp;<\/p>\n<h1>PERSONAL DATA<\/h1>\n<p>Information entered by the customer will be recorded on the platform, which guarantees their complete protection and integrity.
