The contractual documents binding Users in the context of using the Services are, in order of priority (hereinafter “Contractual Set”):
These documents are listed in this order and explicitly referenced during the registration step or first-time use of any NGRTS service. Acceptance of these documents is always displayed in the form of links that allow the documents to be downloaded.
The documents are freely downloadable from the website homepage.
To access the service, the customer must accept the contractual set defined above and acknowledges that by using any NGRTS service under the conditions defined herein, they declare having read and accepted them without reservation.
User acceptance is confirmed by clicking the checkbox on the Website when creating a User Account or prior to the Electronic Signature of a Document using the Service.
The customer implicitly acknowledges that acceptance of the contractual set does not require a handwritten or electronic signature.
Electronic signature is a technical process that gives electronic documents the same value as paper documents. This process ensures the identification of the signatory, the integrity of the document, and demonstrates the signatory’s consent to the signed document.
The implemented process enables:
Access to and use of the NGRTS service requires that the customer has the legal capacity and authorizations to commit under these terms; that they have a valid email address, an active personal phone number, and all hardware and software necessary for web browsing and opening and saving pre-contractual or contractual documents to be signed.
Access to and use of the service requires the creation of a user account; the customer must first register on the NG-SIGN website (https://app.ng-sign.com.tn or https://app.ng-sign.com).
For any transaction, your signature will be triggered and affixed when you click the “sign” button, thereby expressing your consent to the obligations of the signed document. A copy of your electronically signed document will be sent to you by email.
The NGSign and QRSecure services operate 24/7; except in cases of force majeure or difficulties related to the structure of communication networks.
In accordance with the law, NG TECHNOLOGIES cannot be held liable for any damage resulting from customer fault or an unforeseeable and insurmountable event by a third party external to the provision of the service or a case of force majeure.
The user is prohibited from any fraudulent use of the service and, in general, any activity through the service that would violate applicable laws and regulations.
In any event, NG TECHNOLOGIES cannot be held liable for indirect damages that may result from the use of the website and/or service. Indirect damages are those that do not result exclusively and directly from a failure of the website or service attributable to NG TECHNOLOGIES, namely losses of operation and commercial damages.
NGRTS services are delivered in SaaS (Software as a Service) mode. They may be supplemented, modified, or replaced at any time based on technological innovations, legislative advances, or updates to improve service performance and functionality.
Consequently, in the event of modifications to the Terms of Use, NG TECHNOLOGIES undertakes to inform users of any new version of the Terms of Use by all available means.
NG Technologies strives to provide a quality Service with 24/7 availability.
NG Technologies cannot be held responsible for the proper functioning of the User’s computer or telephone equipment or their access to the Internet or a mobile telephone network.
NG Technologies undertakes to deploy its best efforts, in accordance with industry standards, to secure the Service.
In the context of accessing the Service, the User is expressly reminded that the Internet is not a secure network. Under these conditions, it is the User’s responsibility to take all appropriate measures to protect their own Data and/or software, particularly from potential misappropriation and contamination by viruses circulating on the Internet or intrusion by third parties into their information system for any purpose, and to verify that transmitted files do not contain any computer viruses.
NG Technologies disclaims all liability regarding the spread of computer viruses and all consequences that may result from such viruses.
Information entered by the customer will be recorded on the platform, which guarantees their complete protection and integrity. They may be subject to the right of access and rectification under the conditions provided by Organic Law No. 2004/63 of July 27, 2004, relating to the protection of personal data.
Information transmitted or collected via an NGRTS service is considered confidential and is not subject to any external communication, except for exceptions related to applicable legal and regulatory provisions.
The total or partial reproduction or representation of pages, data, and any other constituent element of the website, by any process or medium whatsoever, is prohibited and constitutes, without the publisher’s authorization, an infringement subject to penalties in accordance with the law.
It is noted that the confidentiality of correspondence is not guaranteed on the network and that it is the responsibility of each Internet user to take all appropriate measures to protect their own data, sources, and software from contamination by viruses circulating on the web.
In the event of a dispute arising regarding the Terms of Use, the parties undertake to first seek a solution to their problem through amicable means and to collaborate in good faith to resolve their dispute.
If the parties fail to reach an amicable solution, the most diligent party may refer the matter to the competent court to settle the dispute in accordance with Moroccan law.
These Terms of Use are applicable from the first use of the Service by a User and for the entire duration of use of the Services.
